As Leaf Brands tells it, at least, there are some subtle but real differences between a Hydrox and an Oreo cookie. They claim that the cookie part of a Hydrox uses darker chocolate and offers more of a crunch than what you'd get from an Oreo (though it'd be interesting to see how it holds up to a milk bath).
The latter was manufactured by Sunshine Biscuits, while Oreos were and still are manufactured by Nabisco. When Sunshine Biscuits closed, Hydrox cookies were eventually taken over by Keebler, who renamed the cookies Droxies.
The rest, as they say, is history. But while Oreo ascended to become something of a cultural touchstone, Hydrox retained its partisans, in part also because the slightly-more-bitter cookie was also kosher. The legacy of Sunshine Biscuits also didn’t suffer too badly, and Jacob Loose died a rich man. (Two words: Cheez-It.)
As Gizmodo details, in 2018 Leaf Brands lodged a complaint to the Federal Trade Commission alleging that Mondelez was hiding Hydrox in stores. Leaf Brand bolstered its claims by posting photos of Hydrox cookies being relocated to less visible shelves and placed behind other products.
